• By signing the lease / rental agreement, the Lessee confirms that he/she has completely understood the conditions listed in the agreement as well as the general conditions brought out below and agrees with them.

• By signing the lease / rental agreement, the Lessee gives ABSR Autorent OU the right to preserve and process agreement personal data (including, for instance, control of credit-worthiness of the Lessee and physical and electronic protection of assets of ABSR Autorent OU).

• By signing the lease / rental agreement, the Lessee gives ABSR Autorent OU the right to debit all fees connected to the agreement along with additional fees from the Lessee’s credit card, debit card and/or deduct them from the deposit.

• When leasing / renting a car, it is necessary to present a valid driver’s license, identity document (i.e. an identity card or passport) and a valid credit card or a debit card verified as a credit card*.

• In case the driver’s license is issued outside of European Union (EU) countries, International Driving Permit (IDP) together with driver’s license may be required.

• The car may be driven only by the person listed in the lease / rental agreement, i.e. the rental agreement functions as an authorization.

• An additional driver (drivers) can be added to the lease / rental agreement for an additional fee.

• The drivers listed in the lease / rental agreement must be at least 25 years old and have at least 5 years of driving experience at the time the rental agreement is concluded.

• The lease / rental prices include VAT, mileage according to the chosen period and price group, the charges for regular maintenance, motor third party liability insurance and voluntary motor insurance (Casco) as well as 24 hour car assistance

• The lease / rental prices do not include fuel costs.

• An additional fee for the car’s exterior wash (100 EUR) may be added to the lease / rental amount.

• The lease / rental prices will be calculated based on the lease / rental period — i.e. cheaper monthly prices correspond to longer periods and vice versa.

Provided that the initially agreed upon lease / rental period becomes shorter, the lease / rental prices will be re-calculated according to the actual rental period.

• The lease / rental prices do not include the cost of motor third party liability insurance.

• The lease / rental prices do not include voluntary motor insurance costs.

• Provided that the car gets stolen, the Lessee’s personal liability is 15% of the car’s insurable value, provided that the Lessee returns both the car keys and documents to the Lessor.

• Insurance excess / personal liability is applied to each insurance case. Damages caused by different actions or events will be deemed as separate insurance cases.

• The car’s tires and rims are not insured and the Lessee is fully proprietarily liable for them (for instance, in case of a broken tire or rim, etc.).

• The car’s keys and documents are not insured and the Lessee is fully proprietarily liable for them (for instance, in case the keys/documents become lost, destroyed, etc.).

• The estimated lease / rental fee (incl. the chosen additional services) will be paid as an advance payment before the beginning of the lease / rental period, but final settlements will take place once the lease / rental period concludes.

• It is possible to pay by credit card, debit card, bank transfer (according to an invoice).

• In case the car is returned before the agreed time, the lease / rental fee paid in advance will not be returned, unless agreed upon differently.

• In case the Lessee delays the lease / rental payment or any other amount payable under the contract, the Lessee shall pay default interest to Lessor at the rate of 0,1% of the overdue amount per day of delay

• Upon leasing / renting the car, the Lessee must present a credit card or debit card verified as a credit card* (Visa, MasterCard, American Express) that has been issued in his/her name and which has a sufficient limit. Maestro cards are not accepted for deposit.

• The deposit, which usually remains between 1 -2 months of lease /rent amount, will be booked from the Lessee’s credit card before the lease / rental period commences.

ABSR Autorent OU retains the right to demand a larger deposit if necessary. A bank transfer and/or a letter of guarantee can in some instances be accepted as a deposit as well.

• The deposit will be used to cover any possible future damages and/or accounts and is returned or used for the settlement of accounts once the lease / rental period concludes.

• Provided that there are no claims, the deposit will usually be released within 10–15 workdays. A transaction in the amount of 0,01 EUR (one euro cent) will be concluded in order to release the deposit.

• The owner of the credit card will be noted as the main Lessee (the main driver) in the lease / rental agreement; all other persons may be added as additional drivers upon request.

• ABSR Autorent OU does not accept deposits in cash.

Minimum lease / rent period – 1 (one) month.

The rental periods will be calculated as follows:

• Month = 30 days

• Year = 365 days

• The car will be delivered to the Lessee with a full gas tank, in technical order and clean.

• A vehicle condition report will be compiled upon delivering the car, listing all of the car’s existing damages/defects. By signing the inspection report, the Lessee agrees to the conditions of the car as described in the report.

• When the car is returned, the fuel tank must be full, unless agreed upon differently.

• When the car is returned, the interior of the car has to be clean.

• The lease / rental prices include mileage according to the kilometers specified in the offer and/or agreement.

• Upon request, it is possible to select an agreement with unlimited mileage.

• The Lessee commits to using the car prudently and for the intended purpose as well as to return it in an equivalent condition as prior to the beginning of the rental period.

• The Lessee commits to following traffic rules, good practice and valid legislation.

• It is forbidden to smoke or use drugs and/or alcohol in the car.

• It is forbidden to drive the car outside of EU and CIS countries without ABSR Autorent OU written agreement.

• It is forbidden to drive the car on unpaved roads or roads that are in a condition or with a surface that might cause harm to the car’s rims, tires, body mechanisms and/or details.

• It is forbidden to drive the car on any racetrack or speedway, use the car for participating in any races, rallies, tests, etc. It is also forbidden to use the car for driving lessons, paid passenger transportation, transporting hazardous substances,

live animals or for other similar purposes.

• In case a technical failure occurs, ABSR Autorent OU will provide a replacement car if possible.

• All third party claims caused by the Lessee and/or users of the car during the lease / rental period (e.g. traffic rule violations, fines for delay, parking fines, car towing fees, warning fines for speeding, etc.) are subject to compensation by the Lessee

and/or car users also a  posteriori.

• By signing the lease / rental agreement, the Lessee gives ABSR Autorent OU the right to debit all fines for delay, parking fines, warning fines and other fees along with the service charges from the Lessee’s credit card, debit card and/or deduct them from the deposit

also after the lease / rental period has concluded.

• In case of third party claims, the Lessee commits to paying contractual penalty in the amount of 100 EUR, to which third party claim (e.g. a parking fine or similar) will be added.

• In case of missing fuel, the Lessee commits to paying contractual penalty in the amount of 100 EUR, to which the cost of the missing fuel will be added.

• In case of lost parking ticket or fuel discount card, the Lessee commits to paying contractual penalty in the amount of 100 EUR.

• For the thorough cleaning of the car’s interior the Lessee commits to paying a fee of 100 EUR, for the dry cleaning of the car’s interior the Lessee commits to paying a fee of 100 EUR

• In case of missing car equipment or additional equipment, the Lessee commits to paying contractual penalty in the amount of 100 EUR, to which the costs for replacing the missing equipment according to the car agency’s price lists will be added.

• In case the car documents become lost/destroyed, the Lessee commits to paying contractual penalty in the amount of 100 EUR, to which a state fee will be added according to valid legislation.

• In case the car key(s) become lost/destroyed, the Lessee commits to paying contractual penalty in the amount of 100 EUR, to which any expenses for replacing the keys according to the car agency’s price lists will be added.

• Upon violating the prohibition to smoke and/or use alcohol/drugs in the car, the Lessee commits to paying contractual penalty in the amount of 1000 EUR.

• Upon using the car for other than the intended purposes and/or imprudent use (ie, if the Lessee does not use the car according to the manufacturer’s instructions and / or good practices), the Lessee commits to paying contractual penalty in the amount of

1000 EUR, to which any expenses for restoring the car’s pre-rental condition will be added.

• The current conditions remain in force simultaneously with the conditions set in the lease / rental agreement. In case of any conflict between the current conditions and the conditions set in the lease / rental agreement,

the current conditions will remain in force (excl. the personal liability limit).

• Any dispute arising out of the lease / rental agreement shall be subject to the exclusive jurisdiction of the Estonian courts and shall be governed by Estonian law

• ABSR Autorent OU will not compensate any costs caused by the interruption of the trip, indirect costs, loss of profit or other such expenses in case of the car’s technical failure.

• ABSR Autorent OU will not guarantee the availability of cars at any time.

• ABSR Autorent OU retains the right not to lease / rent a car.

• ABSR Autorent OU retains the right to change the prices and conditions without prior notice.
